TERMINOLOGY TO CONSIDER:

https://chere-chere.com– hereinafter “Site”

Users who browse the Site – hereinafter "Users". Users must have full legal capacity and act in a non-professional manner.

User who has placed an order – hereinafter "Buyer".  

User who visits the Site and has or has not initiated a purchase process – hereinafter "Customer".

General Conditions of Sale – hereinafter “GCS”

PURPOSE

These General Conditions of Sale govern the business relationship between CHÈRE-CHÈRE and any user wishing to make a purchase of one or more products sold by CHÈRE-CHÈRE through this Site.

These General Conditions of Sale and Warranty prevail over any other document, except for the specific conditions of pharmacies or parapharmacies selling CHÈRE-CHÈRE products.

CHÈRE-CHÈRE reserves the right to amend these General Conditions of Sale at any time and without notice and we therefore recommend that you read them whenever placing orders.

When the order is confirmed, the customer accepts our General Conditions of Sale by clicking on the tick-box available for this purpose.

PRODUCTS

The Products offered for sale by CHÈRE-CHÈRE are those listed on the Site on the day of consultation by the User and within the limits of available stocks. 

Photographs of the Products may show minimal differences from the Products purchased and are not intended to be misleading as far as the basic characteristics of the Products are concerned.

Should the Customer require additional information regarding the basic characteristics of the Products (as provided in their description) please contact CHÈRE-CHÈRE by e-mail at global@chere-chere.com. 

Should the Customer detect a discrepancy between the price and/or basic characteristics of the product and its presentation on the website, we ask that they also contact CHÈRE-CHÈRE at global@chere-chere.com. In these circumstances, the Customer is fully entitled to cancel their order.

PRICE

The prices of the Products are given in euros (€) and take into account the taxes applicable on the day the order is placed. 

CHÈRE-CHÈRE reserves the right, which the User accepts, to change its prices at any time. However, all Products will be invoiced based on the pricing in force at the time the order is completed.

The prices indicated do not include shipping charges and the delivery costs will be displayed to the Customer before final confirmation of the order.

ORDERS

The User may freely browse the various pages on the Site without committing to placing an order for Products.

The Customer has the option to register on the site should they so wish. To place an order, you must select the different Product(s) you wish to purchase by clicking on the "Buy" button. This adds the Product to the "Cart", which can be seen in the top right corner.

When the user adds the product to the cart it is updated in the header showing the number of products and their total value. 

When adding, a message is displayed to the user with an option to continue shopping or begin the check-out process.

The Customer can view a summary of the Products they have selected at any time by clicking on the "View cart" icon in the upper corner of their screen and/or amend or delete all or part of their order. This summary includes the list of products and the quantity.

At the check-out, the Customer is provided a form to fill in with the order delivery information, all fields being mandatory.

After filling in this form the billing details are requested, which in most cases will be the same as the delivery details. For this reason, the billing details form only asks for the taxpayer number as an optional field. If the User wishes, they may enter billing details that are different from the delivery details, in which case they should fill in the form provided.

During order processing, the customer can change and correct their details, including the contents of the "Cart” and the delivery and billing address, before final confirmation of the order.

Products selected and added to the "Cart" are saved for a period of 24 minutes.

PAYMENT

After inputting all the required information, the Customer will be presented with the available options for paying for the order, through the Credit Card, MBWay, Multibanco and Paypat. 

The Site accepts the following payment methods:

All information provided to process the payment will be encrypted using the S.S.L. (Secure Socket Layer) protocol. 

The technical solutions used by Hipay comply with the most stringent criteria for transaction security and banking data protection. At no time do the Buyer's bank details enter CHÈRE-CHÈRE computer system.

ORDER COMPLETION

The Customer must click on "Complete Purchase" to finalise the order.

After finalising/processing the payment, the Site generates a page displaying confirmation of the order. A confirmation email with the order number and details will also be sent to the email address provided by the Buyer.

If any Product is out of stock, the Buyer will be contacted by CHÈRE-CHÈRE to resolve the situation according to the Buyer's preference. 

 If you make an error when entering your e-mail address, we ask you to e-mail CHÈRE-CHÈRE at global@chere-chere.com. CHÈRE-CHÈRE will not be liable in such circumstances.  

If the order confirmation is not received within 24 hours of the order being placed, the Buyer should contact Customer Services by e-mailing global@chere-chere.com. 

The other conditions regarding the return of Products are governed by the Returns Policy.

DELIVERY AND RETURNS

The order will be dispatched after confirmation by the Buyer. The usual delivery time is 48h after the order is processed in the case of mainland Portugal (and 5 Dayse for the Islands and the rest of Europe.) 

The Products ordered may be delivered in national (and international territory. )

The invoice for the sale transaction will be sent to the Buyer together with the order.

Upon receipt of the Products, the Buyer should check that they are as ordered, and any identified defect should be immediately reported to CHÈRE-CHÈRE. Please see our Returns Policy for more information.

If the order is returned to CHÈRE-CHÈRE, any return costs may be charged to the Buyer. 

CHÈRE-CHÈRE cannot be held responsible for delivery of the Product to a third party if requested by the Buyer.

CHÈRE-CHÈRE denies all liability in the event of non-delivery or delayed delivery due to force majeure events, acts attributable to third parties or any reason attributable to the Buyer. If delivery is delayed, the Buyer should inform CHÈRE-CHÈRE by email at global@chere-chere.com.

RIGHT OF WITHDRAWAL

The Buyer shall have a period of fourteen (14) working days to notify CHÈRE-CHÈRE of its wish to cancel the purchase and sale. This period starts from the day the order is received. In order to exercise the right of withdrawal, the Buyer should inform CHÈRE-CHÈRE of their decision within this period and by post. For more information, please see our Returns Policy.

LEGAL GUARANTEE

CHÈRE-CHÈRE undertakes to comply with the legal provisions in force under the Consumer Code and the Civil Code.

PROTECTION OF PERSONAL DATA

At CHÈRE-CHÈRE we want our Customers to be aware of the general privacy rules and the conditions for processing the data we collect, strictly observing and complying with the applicable law in this area, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 ("General Data Protection Regulation" or "GDPR") and the law implementing the General Data Protection Regulation (GDPR), Law 58/2019 of 8 August ("Law 58/2019"), in everything that does not conflict with the GDPR and until a new law must be applied, and also the guidelines issued by the National Commission for Data Protection ("CNPD").

COMPREHENSIVENESS OF THE CONTRACT

These General Conditions of Sale and the Order Confirmation sent to the Buyer make up the contractual documentation and constitute the entire contractual relationship between the Buyer and CHÈRE-CHÈRE. Should there be any inconsistency between said documents, these general conditions of sale shall prevail. 

FORCE MAJEURE

CHÈRE-CHÈRE shall not be liable for any defect, delay or failure to fulfil its obligations under the General Conditions of Sale in situations where force majeure occurs.

JURISDICTION

Sales of CHÈRE-CHÈRE Products through this Site are subject to Portuguese law regardless of the buyer’s country of origin or where the order was placed and/or delivered. For the resolution of any disputes arising from the interpretation or execution of these General Conditions of Sale, the court of the district of Lisbon shall have jurisdiction, to the exclusion of all others.

PAYMENT INFORMATION

Types of payment accepted at https://chere-chere.com : Credit Card, MBWay, Multibanco, PayPal, Apple Pay and American Express.

Europe has introduced new requirements to authenticate online payments as part of the second Payment Services Directive (PSD2).

Strong customer authentication (SCA) is a new European regulatory requirement to reduce fraud and make online payments more secure. The requirement ensures that electronic payments are made with multi-factor authentication to increase security.

This requirement adds an extra step, for eligible transactions only, after checkout where the card holder is asked by the bank to provide additional information to complete a payment (e.g., a unique code sent to their phone or fingerprint authentication via their mobile banking app).

SECURE PAYMENT INFORMATION

All sensitive data, including payment information, is encrypted and transmitted over networks protected by the industry-wide SSL (Secure Socket Layer) security protocol.

Should any type of unauthorised debit appear on your credit card following any purchase on the  https://chere-chere.com site, you must immediately alert your bank.

SHIPPING

CHÈRE-CHÈRE takes the current Covid-19 pandemic situation into account throughout its processes. All the hygiene and safety measures advised by the Directorate-General of Health (DGS) and the WHO are, therefore, considered when preparing your order.

Our partners responsible for transporting the order also guarantee the greatest care in their processes. 

 RULE AND RESTRICTIONS:

- Orders are shipped Monday through Friday, excluding holidays.

- EAll deliveries require the signature of the person receiving the parcel. This process has been put in place to ensure that the customer actually receives the item(s) ordered.

- The usual delivery time is 48h days after the order is processed in the case of mainland Portugal (and 5 days for the Islands and the rest of Europe). However, given the current pandemic situation, we cannot ensure that delivery will meet the anticipated time frames. 

SHIPPING TO A DIFFERENT ADDRESS

When entering the billing address details during the payment process, the customer will be given the option to enter a different shipping address, within the same country.

CHÈRE-CHÈRE reserves the right to contact the customer by telephone for further information if the customer provides a shipping address that is different to the billing address.

If the Customer provides a wrong, inaccurate or incomplete address, CHÈRE-CHÈRE will not be liable for reshipping and delivery costs. 

ORDER PROCESSING TIME

The order process starts as soon as your online purchase is complete. The order will start being processed as soon as the items are in stock, the payment is approved, and the delivery address is verified. 

Upon dispatch of the order, the customer will receive an e-mail notification with this information.
